Terms of Service

1. Agreement
These Terms of Service (“Terms”) govern your use of HostPanda websites, client area, and hosting services at hostpanda.uk (the “Services”). By creating an account, placing an order, or using the Services, you agree to these Terms.
If you are buying for a business, you confirm you have authority to bind that business.
2. Accounts and eligibility
You must provide accurate contact and billing details and keep them up to date. You are responsible for activity under your account and for keeping login credentials secure.
We may refuse, suspend, or terminate service if we reasonably believe information is false, payment fails, or these Terms are breached.
3. Hosting services
We provide shared web hosting and related features described on your plan at the time of purchase (storage, email allowances, SSL, and support). Features may change as we improve the platform; material reductions will be communicated where practical.
You are responsible for your websites, content, email, backups you download, DNS settings you control, and software you install. We are not liable for content you publish or for third-party plugins, themes, or applications you choose to run.
4. Acceptable use
You must not use the Services to:
- Break applicable law or infringe intellectual property rights
- Distribute malware, phishing, spam, or abusive bulk email
- Attack, scan, or disrupt other systems or networks
- Host content that is exploitative of minors or promotes violence
- Mine cryptocurrency or run workloads that unfairly degrade the server for others
We may suspend or remove accounts that harm the platform, other customers, or our providers, with or without prior notice when urgency requires it.
5. Orders, billing, and renewals
Prices are shown at checkout in the stated currency. Payment is processed by our payment provider (Stripe). Subscriptions renew at the chosen interval (monthly or yearly) unless cancelled in the client area or via the billing portal before the renewal date.
Failed payments may lead to suspension after notice. Reactivation may require settling outstanding balances. Taxes may apply where required by law.
6. Cancellations and refunds
You may cancel renewal so service ends at the end of the current paid period. Early termination of a prepaid term does not automatically create a pro-rata refund unless we say otherwise in writing or a mandatory consumer right applies.
If a service cannot be delivered due to a fault on our side, contact contactus@hostpanda.uk and we will work on a fair remedy (repair, credit, or refund as appropriate).
7. Support and uptime
We aim to keep services available and to reply to support requests promptly, typically within one business day. Planned maintenance may cause brief downtime. Uptime figures in marketing are targets, not absolute guarantees, unless a separate written SLA says otherwise.
8. Data and privacy
How we handle personal data is described in our Privacy Policy. You remain the controller of personal data you store in customer websites and mailboxes; you must have a lawful basis to process it.
9. Intellectual property
HostPanda branding, site design, and documentation remain our property. Your content remains yours. You grant us a limited licence to host, backup, and display that content as needed to run the Services.
10. Limitation of liability
To the fullest extent permitted by law, HostPanda is not liable for indirect, incidental, or consequential loss (including lost profits, data, or business), or for outages caused by upstream networks, third-party providers, or force majeure.
Our total liability for any claim relating to the Services is limited to the fees you paid us for the affected service in the three months before the claim. Nothing in these Terms limits liability that cannot be limited under applicable law (including death or personal injury caused by negligence, or fraud).
11. Changes
We may update these Terms from time to time. The “Last updated” date will change when we do. Continued use after changes take effect means you accept the revised Terms. For material changes, we will try to notify account holders by email or a notice in the client area.
